FORM Vintage

Please read these Terms and Conditions ("Terms") carefully before using formvintageshop.com (the "Site") or purchasing any product from FORM Vintage ("FORM Vintage," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Overview of Our Business
FORM Vintage sells curated vintage and original art prints, including lithographs, etchings, screenprints, posters and exhibition prints, sourced from private collections. Each listing includes our description of the work to the best of our knowledge based on available information at the time of sourcing.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase on the Site. By placing an order, you represent that you meet this requirement.
3. Products, Pricing, and Availability
All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse any order at our discretion.
Because we sell vintage and one-of-a-kind or limited-availability items, errors in listings (including pricing, availability, or description) may occasionally occur. We reserve the right to correct any errors, cancel any affected order, and issue a full refund, even after an order has been confirmed.
Prices are listed in U.S. dollars unless otherwise stated and do not include applicable taxes, duties, or shipping costs, which will be calculated and disclosed at checkout. We do not control or hold liability over any customs duties and costs imposed by your international territory when shipping outside of the United States.
Condition and Variations. Due to the vintage, collectible, and secondary-market nature of our inventory, products may show age-related wear, restoration, discoloration, toning, framing changes, edge wear, handling marks, or other imperfections consistent with age and prior ownership. Product photographs form part of the item description but may not perfectly reflect color or scale due to device display differences.
No Investment Representation. We do not represent or guarantee future value, appreciation, investment performance, rarity, museum status, or resale potential of any item.
4. Orders and Payment
By placing an order, you are making an offer to purchase the item(s) in your cart, which we may accept or decline. Payment is processed securely through our third-party payment provider(s) (Shopify Payments or PayPal). FORM Vintage does not itself receive, store, or have access to your full payment card details — these are collected and stored directly by our payment processor in accordance with PCI-DSS security standards.
We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability.
Order Verification and Fraud Prevention. We reserve the right to request additional information to verify identity, payment authorization, billing information, shipping information, or intended use before accepting or fulfilling an order.
Order acceptance occurs only when shipment confirmation is issued.
5. Shipping, Risk of Loss, and International Orders
Shipping timelines and costs are provided at checkout and are estimates only. FORM Vintage is not responsible for delays caused by carriers, customs authorities, or events outside our reasonable control.
Risk of loss and title for products purchased from FORM Vintage pass to you upon our delivery to the shipping carrier.
For international orders, you are responsible for any customs duties, import taxes, or fees levied by your country. FORM Vintage has no control over these charges and cannot predict their amount. We accurately describe the contents and declared value of shipments on customs documentation.
Delivery Claims. Any claim relating to damage in transit, delivery discrepancy, missing contents, or shipment error must be submitted in writing within five (5) calendar days after confirmed delivery and include photographs of the item, packaging, shipping label, and any supporting documentation reasonably requested by us.
Returned Shipments. Orders returned due to refusal of delivery, failure to pay customs charges, incorrect address submission, or failure to collect the shipment may be refunded less shipping charges, customs charges, carrier fees, return fees, and reasonable handling costs.
Export Controls and Restricted Destinations. We reserve the right to decline, cancel, or restrict orders where shipment, import, export, sanctions, cultural property restrictions, or applicable law would make fulfillment impractical or unlawful.
6. Returns and Refunds
Given the vintage and often one-of-a-kind nature of our inventory, products are available at varying levels of condition. Please read the description of items prior to purchase to review the items condition before making a decision to purchase. As we do not offer change of mind product returns.
If your product was damaged during shipping we recommend you file a claim with the shipping company online to claim a refund. If you need assistance with this please contact us at formvintagela@gmail.com. We also have the ability to file a claim for coverage should you have issues with the shipping company processing this for you. However we will need to access the damage with photos and a variety of other information which we can discuss with you at the time. We withhold the rights to decline the return if both the insurance company and the shipper provide just cause for declining your refund.
Inspection Requirement. Returned items are subject to inspection upon receipt. Refunds may be reduced or denied to the extent an item is returned damaged, altered, reframed, improperly packaged, or in materially different condition from when shipped, except where prohibited by applicable law.
No Chargeback Circumvention. Customers agree to contact us and provide a reasonable opportunity to resolve order concerns before initiating a payment dispute or chargeback.
7. Intellectual Property on the Site
7.1 Our Content
All content on the Site that we create — including our original product photography, written descriptions, blog and journal articles, logos, graphics, and overall site design — is owned by or licensed to FORM Vintage and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission, except for ordinary personal use such as viewing the Site or sharing a product link.
7.2 Third-Party Artworks, Images, and Likenesses
The products sold on the Site are, in many cases, original works or reproductions created by third-party artists who are not affiliated with FORM Vintage. Any reference to an artist’s name, the use of an artist’s name in product titles or descriptions, and any underlying artwork depicted in our photography is used solely to accurately identify, describe, and sell the physical item in our possession, consistent with the nominative fair use of a name or mark to describe genuine goods.
We do not claim ownership of the underlying copyright in any third-party artwork, and nothing in these Terms or on the Site should be construed as a representation that FORM Vintage holds, has obtained, or is required to hold a license from the artist, the artist’s estate, or any rights-holder in order to resell a lawfully acquired, physical, secondary-market copy of a work. Resale of lawfully purchased physical artworks is generally permitted under the first-sale doctrine and equivalent principles in most jurisdictions; this paragraph does not apply to any reproduction, copying, or distribution of an image of the artwork beyond what is reasonably necessary to advertise the specific physical item for sale.
Photography, video, and editorial content. From time to time, the Site may include photographs, video, or editorial content that reference, depict, or discuss artists, estates, photographers, or other third parties, including biographical or historical information published for editorial and informational purposes (such as our Journal articles). Where such content incorporates third-party photography or images, we use sources we believe in good faith to be in the public domain, openly licensed (including but not limited to Creative Commons or museum open-access programs), or used in a manner consistent with fair use principles for commentary, criticism, and educational purposes. FORM Vintage does not knowingly use copyrighted images or footage of any individual without an appropriate license or legal basis to do so.
No claim of endorsement. Reference to any artist, estate, photographer, or other individual or entity on the Site does not imply that such person or entity endorses, sponsors, or is affiliated with FORM Vintage, unless explicitly stated.
No Authentication Obligation. Except where explicitly stated in a product listing, FORM Vintage does not undertake an obligation to obtain, provide, or fund third-party authentication opinions, catalogue raisonné inclusion, estate confirmation, or forensic analysis.
7.3 Notice and Takedown — Rights Holders and Talent
FORM Vintage respects the intellectual property and publicity rights of others. If you are an artist, photographer, estate representative, agent, or other rights-holder and believe that content on the Site — including a photograph, video, image, biographical text, or other material — infringes your copyright, right of publicity, or other legal right, please contact us immediately at:

Please include in your request:
- Identification of the specific content you believe is infringing, including the URL or product page where it appears
- A description of your right or interest in the content (e.g., copyright owner, estate representative, the individual depicted, or their authorized agent)
- Your contact information
- A statement that you have a good-faith belief the use is not authorized
Upon receipt of a valid request, we will promptly review the content in question and, where appropriate, remove or modify it. We aim to respond to and resolve good-faith requests within a reasonable timeframe, typically within 5–10 business days. Submitting a request does not guarantee removal in every instance — for example, where we have a documented license, where the use qualifies as fair use or falls under the first-sale doctrine as described in Section 7.2, or where the request lacks sufficient information for us to act — but we will communicate with you in good faith regarding the outcome.
This process is offered as a practical resolution mechanism and does not waive, and should not be construed as a waiver of, any legal right, remedy, or defense available to FORM Vintage under applicable law.
8. User Conduct
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to the Site, our systems, or other users’ accounts
- Interfere with the proper functioning of the Site
- Scrape, harvest, or collect information from the Site using automated means without our consent
- Submit false or misleading information when placing an order
We reserve the right to suspend or terminate access to the Site for any user who violates these Terms.
9. User-Submitted Content
If you submit reviews, comments, images, or other content to the Site (for example, a product review), you grant FORM Vintage a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, and distribute that content in connection with our business, including on the Site and in our marketing. You represent that you own or have the necessary rights to submit such content and that it does not infringe any third party’s rights.
We reserve the right to remove any user-submitted content at our discretion.
10. Disclaimers and Limitation of Liability
THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE PROHIBITED BY APPLICABLE LAW.
To the fullest extent permitted by law, FORM Vintage, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Site or any product purchased, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability to you for any claim arising from your use of the Site or a purchased product shall not exceed the amount you paid for the product giving rise to the claim.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site, any purchase, or these Terms shall not exceed the greater of (a) the amount paid for the product giving rise to the claim or (b) USD $100.
No liability limitation in these Terms applies to any liability that cannot lawfully be excluded or limited under applicable law.
Claims Deadline. To the fullest extent permitted by law, any claim relating to a purchase, use of the Site, or these Terms must be brought within one (1) year after the claim arises.
11. Indemnification
You agree to indemnify, defend, and hold harmless FORM Vintage and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your breach of these Terms or your misuse of the Site.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles, except where applicable consumer protection laws of your country or state of residence require otherwise.
Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the exclusive jurisdiction of such courts, except where applicable law provides you with a right to bring a claim in your local jurisdiction.
Nothing in this Section limits any mandatory rights consumers may have under applicable consumer protection laws that cannot legally be waived.
13. International Buyers
If you are purchasing from outside the United States, you acknowledge that:
• Products are sold from and shipped from the United States;
• Import eligibility, customs clearance, cultural property restrictions, and local purchase restrictions remain your responsibility;
• Duties, VAT, GST, customs fees, currency conversion fees, and similar charges remain your responsibility unless explicitly collected at checkout;
• Mandatory consumer protections in your jurisdiction may apply notwithstanding these Terms.
14. Changes to These Terms
We may revise these Terms at any time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Authenticity
Authenticity disclaimer. While we take care to research and describe each work accurately, including medium, period, and provenance where known, FORM Vintage is not a certified appraisal service, and many works in our collection are sold without formal certificates of authenticity from the artist’s estate or a third-party authentication body. Descriptions reflect our good-faith assessment based on visual inspection, dealer information, our teams expertise and publicly available research. We do not guarantee, warrant, or represent that any item is an original work, a particular edition, or attributable to a specific artist beyond what is stated in the listing, and all sales are made on that basis. If formal authentication matters to you, please contact us prior to purchase so we can share what documentation, if any, is available for a specific piece.
17. Business Customers
Where products are purchased for commercial resale, gallery use, professional display, or business purposes, you acknowledge that consumer-specific protections available under certain laws may not apply to the extent permitted by applicable law.
18. Force Majeure
FORM Vintage shall not be liable for delay, interruption, or failure to perform caused by events outside our reasonable control, including carrier disruption, customs delays, labor disputes, natural disasters, government action, internet outages, sanctions restrictions, or supply interruptions.
